Initial Consultation & Fees
Upon initial contact a Consultation may be scheduled. This is a very important step in whatever services are needed. During the Initial Consultation, representation and direction of the case are determined. It is important there is a good rapport between attorney and the client as Matrimonial cases are intensely emotional. It is critical to have a good collaborative relationship between attorney and a client. It is during the Consultation that the particulars of the case; the history of the client’s marital relationship, the causes of its demise and the client’s goals and expectations are outlined. Mr. Rudder, with his extensive experience in these matters, dealing with the courts and judicial process, clearly explains the divorce laws of New York State to the client, outlines the rights, duties and obligations of the parties, both economic and parental, when appropriate. In light of information presented, the potential for reconciliation (pre-commencement) may also be addressed.
Some of the topics to be addressed in the Consultation are:
- Financial obligations and rights/entitlements
- Home occupancy rights
- Property rights, entitlements and distribution/division claims
- Parental rights and duties
- Custody claims
- Child decision making authority
- Child/ Spousal maintenance determinations
- Effects of any Pre-Nuptial agreemenPresence of domestic violence: protective orders
- Legal fees, responsibility for payments
If, in fact, it is decided to proceed, the initial consultation fee becomes a part of the retainer.
