Types of Child Custody in New York

  • Sole Custody - A court-ordered arrangement wherein one parent has both legal and physical custody of the child.
  • Joint Custody - A more common setup wherein both parents will have a shared legal custody of the child.
  • Legal Custody - The parent who has the legal custody of the child has the right to make important life decisions on behalf of their child.
  • Physical Custody - The child will live with the parent who provides the care on a daily basis.

Both legal and physical custody can be sole or joint.
